2. Product Information & Nature of Goods

All products sold by Laura Kay’s Elderberry include perishable food items and herbal wellness products, including but not limited to elderberry syrup.

Our products are:

  • Handmade in small batches
  • Intended for general wellness support
  • Not pharmaceutical products
  • Not guaranteed to prevent or cure illness

Due to the natural nature of our ingredients, slight variations in taste, color, or texture may occur and are normal.

3. FDA & Medical Disclaimer

Statements made on this website have not been evaluated by the Food and Drug Administration (FDA).

Our products are not intended to diagnose, treat, cure, or prevent any disease.

4. Shipping Policy (Perishable Products)

Cold-Season Shipping Only

Elderberry syrup is a temperature-sensitive, perishable product. To maintain quality and safety, we ship syrup only during cold months when temperatures are suitable for transit.

Orders placed outside of this shipping window may be:

  • Delayed
  • Held
  • Or canceled at our discretion

Shipping Days

We ship Monday through Wednesday only, depending on destination, to reduce the risk of packages sitting in transit over weekends.

Customer Responsibility

By purchasing, you acknowledge and agree that:

  • You are responsible for monitoring shipment tracking
  • You must retrieve the package immediately upon delivery
  • The product must be refrigerated immediately upon arrival

Failure to do so may result in spoilage, for which Laura Kay’s Elderberry is not responsible.

5. Delivery Issues & Risk Transfer

Once an order has been shipped and marked as delivered by the carrier:

  • Responsibility transfers to the customer
  • We are not responsible for stolen, delayed, or unattended packages
  • We are not responsible for damage due to weather, temperature exposure, or failure to refrigerate promptly.

6. No Returns, Refunds, or Exchanges

Due to the nature of perishable food products, ALL SALES ARE FINAL.

We do not accept:

  • Returns
  • Exchanges
  • Refunds

This includes situations involving:

  • Delayed delivery
  • Product spoilage due to improper handling
  • Customer unavailability at delivery

7. Damaged or Incorrect Orders

If your order arrives damaged or incorrect:

  • You must notify us within 24 hours of delivery
  • Provide clear photos of the product and packaging

We reserve the right to determine whether a replacement or refund will be issued. Decisions are made at our sole discretion.

8. Storage & Use Instructions

Customers agree to follow all storage and handling instructions provided, including:

  • Refrigeration requirements
  • Use-by or best-by guidelines
  • Proper sealing and sanitation

We are not responsible for adverse outcomes due to misuse, improper storage, or consumption beyond recommended timeframes.

  • Other allergens

While we strive for transparency, customers are responsible for reviewing ingredient lists and determining suitability. Laura Kay’s Elderberry is not liable for allergic reactions or sensitivities.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Laura Kay’s Elderberry shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or misuse of our products or website.
  • Our maximum liability shall not exceed the purchase price of the product.
